IT IS AGREED:

1.      RESPONSIBILITY

1.1.  The user (you/your) must only use the Bodd 3D Scanner strictly as directed and follow all instructions, prompts, or guidance provided by either the Bodd 3D Scanner interface or by a representative of the Merchant where the Bodd 3D Scanner is located.

2.      COLLECTION AND USE OF PERSONAL IDENTIFIABLE INFORMATION (PII)

2.1.  You acknowledge and agree that the data and information obtained from the use of the Bodd 3D Scanner is collected, stored and used by Bodd (we, us) for a variety of purposes, including advertising, marketing and to third parties in order to offers of goods and services tailored to your body measurements and other PII. Credit card information is not stored by us on our servers.

2.2.  We may use PII collected from you for the purpose of providing you with direct marketing material, updates regarding our website and information in the form of a newsletter. This will only apply if you have registered or subscribed to such publications by your registering your details with us. However if you wish to cease receiving any such information you may let us know either by email or unsubscribing at any time and your request will be actioned as soon as possible.

2.3.  We will use all reasonable means to protect the confidentiality of your PII while in our possession or control. We will not knowingly share any of your Personal Data with any third party other than our service providers who assist us in providing the information and/or services we are providing to you.

3.      WAIVER

3.1.  Any and all use of the Bodd 3D Scanner is at your sole risk and liability and we take no responsibility for any loss or injury suffered as a result.

3.2.  You forever release, indemnifies and discharge us from any and all loss and damage suffered as a result of the use of the Bodd 3D Scanner, including injury, non-performance or lack of suitability. All express and implied terms, conditions and warranties which might otherwise apply to, or arise out of the provision of the Bodd 3D Scanner are excluded, other than as expressly set out this document or which cannot be lawfully excluded.

4.      GOVERNING LAW AND JURISDICTION

4.1.  This Letter is governed by the laws of Victoria and the parties submit to the exclusive jurisdiction of the courts of Victoria, Australia.
